Background |
The following articles are enacted as the parking regulations for Southern Polytechnic State University, a unit of the University System of Georgia. These regulations are enacted under the provisions of the laws of the State of Georgia and the regulations of the University System of Georgia enabling institutions within the System to enact such regulations.
Parking matters are administered by Parking Services, a division of the University Police. Parking Services is located in the ground floor center lobby of Norton Hall. The hours for Parking Services are the same hours as published for the Business Office each semester. Extended hours (until 8:00 p.m.) are maintained during the first five (5) regular class days of each semester |

Article I Vehicle Registration |
1. Registration Required
All faculty, staff, and students who operate and/or park a motor vehicle on campus are required to register their vehicles and display a current permit. All registration information provided to Parking Services must be accurate.
2. Student Vehicle Registration Procedure and Guidelines
a) Students must register their vehicles on-line through the Banner system and pick up their permits from Parking Services by the close of business on the 5th regular class day of each semester.
b) Registration is not complete until the permit is permanently affixed to the outside of the driver’s side of the back window in the lower corner.
3. Faculty and Staff Vehicle Registration and Procedures
a) Faculty and staff must register their vehicle upon their employment. Periodic re-registration may be required if Parking Services deems it necessary, provided there is no more than one registration required during an academic year. Should re-registration be required, Parking Services will provide e-mail notification to faculty and staff thirty (30) days in advance of the registration deadline. There is no charge for faculty and staff vehicle registration.
b) Full-time, permanent employees may register their vehicles for faculty and staff zone assignment on-line through the Banner system, or they may do so in person at Parking Services. Part-time employees who are not SPSU students must register their vehicles in person at Parking Services to obtain faculty and staff zone assignment.
c) Faculty and staff permits must be picked up at Parking Services by the person to whom the permit is issued. Identification and employment verification may be required.
d) Part-time employees who are also SPSU students do not qualify for faculty and staff zone assignments.
e) Faculty and staff must display a current permit when parked in faculty and staff zones to be considered properly registered. The permit may be displayed on a rear-view mirror hang tag furnished by Parking Services provided that it hangs freely and is completely visible in an unobstructed manner. Otherwise, the permit must be permanently affixed to the outside of the driver’s side of the back window in the lower corner.
4. Temporary Permits
a) When a student or employee who has registered a motor vehicle must operate an unregistered motor vehicle on campus (e.g. borrowed car, rental, etc.) a two-week permit can be obtained at no charge from Parking Services 24 hours daily.
b) When a student or employee who has not registered a motor vehicle must temporarily operate a motor vehicle on campus, a temporary permit may be obtained from University Police during normal business hours for up to two weeks at a time.
c) Temporary permits must be affixed to the inside of the lower corner on the driver's side of the back window so as to be visible from the outside of the motor vehicle.
5. Permit Transfer Prohibited / Permit Replacement
The permit issued for one motor vehicle cannot be transferred to another motor vehicle or owner. If a permit holder sells or otherwise discontinues operation of a permitted motor vehicle on campus, the permit must be removed. In order to register another vehicle, the permit holder must contact Parking Services and have the permit voided prior to applying for another permit.
Replacement permits will be issued at no charge if the old permit or part thereof is turned in, or if other verification is provided reasonably showing that the permit could not have been transferred to another student. Otherwise, a fee of $25.00 applies.
Permit owners are responsible for any and all tickets issued to their permitted motor vehicle before the permit is declared void by Parking Services.

Article II Visitors |
1. Designated visitor parking spaces are conveniently located in several areas around campus, including areas near the residence facilities.
2. Visitors may park only in designated visitor zones or commuter student parking zones.
3. Faculty, staff, and currently enrolled students are prohibited from parking in spaces designated for visitors.
4. There is no visitor parking located within the resident student parking zones.
5. Friends of the university who visit often may obtain special guest parking permits from Parking Services. Special guest permits are valid for one year and cost nothing.

Article III Parking Regulations |
1. Parking regulations are in effect twenty-four hours a day seven days a week.
2. No more than one current permit will be displayed on a single motor vehicle.
3. There shall be a presumption, subject to rebuttal, that any vehicle on campus which is owned by a family member of a student or employee is being operated by the student or employee, and any ticket issued to that vehicle will be assigned accordingly.
4. No person shall stop, stand, or park any motor vehicle:
a) Where official signs and/or markings prohibit parking;
b) In any area not designated as a parking zone. Any parking space absent a zone designation is assigned to faculty and staff;
c) In contradiction of official signs regulating the length of time a motor vehicle may remain parked in a specific area or the purpose for which a motor vehicle may park in a specific area;
d) In contradiction of official signs designating who may park in a specific zone; or
e) In violation of any parking law or regulation contained within the Official Code of Georgia or the Ordinances of the City of Marietta.
5. In all cases of conflict between signage, regulations in this code, or maps, authorized signs and markings are presumed to be the most recent and will take precedence over any conflicting map or rules contained herein or elsewhere.
6. Only vehicles displaying current faculty and staff registration are permitted to park in designated faculty and staff zones. Faculty and staff areas are not reserved on Saturdays, Sundays, or official employee holidays as announced by the president.
7. Spaces assigned to faculty and staff for specific hours convert to commuter student parking outside of the specified restricted hours. If a faculty-staff member is ticketed for having an unregistered motor vehicle, the violation will be excused if he/she takes it to the University Police within five days of being ticketed and presents the valid sticker and his/her faculty or staff ID.
8. Parking in Undesignated Areas Prohibited - Motor vehicles may park only in designated motor vehicle parking spaces and must be parked fully within the lines of such spaces. Parking is prohibited on lawns, landscaped areas, sidewalks, paved areas not designated for parking, and all other areas not specifically designated by signs, lines, or curb markings as parking areas. The absence of a no parking sign does not mean parking is permissible in an area. If there is no signage or color-coded designation on a space or section of spaces, the space is designated as faculty and staff, and student parking is prohibited there.
9. Commuter students may only park in zones designated and signed for commuter students.
10. Resident students may park only in the zones designated and signed for their specific housing complex.
11. Faculty and staff may park in zones designated and signed for either faculty and staff or commuter students.
12. Overnight or extended parking of campers, vans, buses, etc., utilized as living and sleeping quarters within the university boundaries, is prohibited unless approved by the Parking Services manager.
13. Parking of Inoperable or Dilapidated Motor Vehicles Prohibited - Inoperable or dilapidated motor vehicles may not be parked on the Southern Polytechnic campus. A motor vehicle may be deemed inoperable if it is in an obvious state of disrepair, if it remains unmoved in a location for more than one semester, or if it lacks current/proper licensing sufficient for highway operation as defined by the Official Code of Georgia. A motor vehicle may be deemed dilapidated if it has broken lights, broken windows, flattened tires, or is, in the opinion of a police officer, un-roadworthy under the terms and conditions prescribed by the Official Code of Georgia.
14. Loading Zone Authorization - Authorization to park in designated loading zones may be obtained by any registrant for short periods of time for loading and unloading by calling Parking Services or the University Police dispatcher. Commercial vehicles engaged in loading/unloading need no special authorization to use designated loading zones.
15. Police and Service Motor Vehicles - Police and service motor vehicles may stop, stand, or park irrespective of these regulations while performing necessary official business. Service motor vehicles may not, however, be left unattended blocking a fire hydrant or obstructing the free flow of pedestrian and/or motor vehicle traffic. Police and service vehicles may not park in handicap areas, to include parking in a manner that blocks curb cuts, ramps, or gores, etc. designated for handicapped access.

Article IV Handicapped Parking |
1. With State Issued Permit a) Handicapped persons properly displaying a valid state handicapped permit may park in any handicapped space on campus. If the handicapped spaces near where they need access are filled, they may park in any faculty/staff or time limit space.
b) Persons who do not qualify as visitors as defined in Article II above must also display a valid SPSU parking permit in addition to the state-issue handicapped permit.
2. Temporary Circumstances

Article V Revocation of Parking Privileges |
1. Operation of a motor vehicle on the Southern Polytechnic campus is a privilege which may be revoked for the following reasons:
a) Receiving more than seven (7) valid parking citations in one semester results in a thirty (30) day revocation of parking privileges, or
b) Receiving three (3) valid parking citations for failure to display a current permit results in the revocation of parking privileges until a permit is properly affixed to the vehicle.
2. Any motor vehicle owned or being driven by a person whose parking privileges have been revoked will be impounded or immobilized at the owner's expense if found on campus during the revocation period.
3. Parking Services will attempt to notify those persons whose parking privileges are subject to revocation prior to the revocation taking effect, if it is the first occasion of revocation. Receipt of notification is not necessary to initiate revocation. A notification attempt will be made in one of the ways shown below:
a) By placing an announcement on the motor vehicle;
b) By mailing a letter to any known address associated with the vehicle; or
c) By SPSU account email to the current permit or any former permit holder for the vehicle.

Article VI Impoundment and Immobilization |
1. Motor vehicles parked in violation of the sections specified in this article are subject to impoundment or immobilization at the owner's expense. The vehicle's operator/owner/permit holder is responsible for all wrecker, storage, or immobilization device removal fees. The operator of any vehicle impounded or immobilized must appear in person at the University Police Department to obtain a release. If the vehicle is properly permitted, it will be released to the permit holder upon proof of identification or to the owner upon proof of ownership. If the vehicle is not permitted, it will only be released to the owner upon proof of ownership.
2. Specific offenses or situations subjecting a vehicle to impoundment are as follows:
a) Motor vehicles parked in such a manner as to create a fire/safety hazard or obstruct the free flow of traffic;
b) Parking in designated tow-away zones, at red curb areas, blocking a fire hydrant, unauthorized parking in a handicapped zone, or blocking a handicapped ramp, curb cut, wheel chair safety gore, or other area necessary for handicapped access;
c) In cases of emergency or in the interest of public safety;
d) Parking on lawn areas and sidewalks;
e) When a motor vehicle is presumed to be abandoned, is inoperable, is dilapidated, or is in a visible state of disrepair and the owner cannot be contacted;
f) When parking privileges have been revoked;
g) When a driver parks or refuses to move a motor vehicle in contradiction to the direction of any Parking Services personnel, law enforcement, fire services, emergency medical services, or other emergency management personnel; or
h) Under provisions of Georgia law allowing the impoundment of vehicles.
3. Specific offenses or situations subjecting a vehicle to immobilization:
a) Second offense of parking in a restricted area, including but not limited to unauthorized parking in faculty and staff, resident student, or loading zones; or
b) When parking privileges have been revoked, the vehicle may be immobilized rather than impounded at the sole discretion of Parking Services.

Article VII Fines |
1. Fine Schedule
2. Fines incurred by students are assessed to their student accounts and paid at the business office.
3. Fines incurred by faculty and staff are payable at the business office. Fines unpaid after six months or at the end of a fiscal year will be collected by payroll deduction.
4. All other fines will be collected by the business office.

Article VIII Appeals |
1. All persons who have been ticketed for violations of the parking code or who have had their parking privileges revoked have the right of appeal, provided the appeal is made within ten (10) calendar days of receipt of a ticket or notice of revocation. Any ticket or act of revocation under appeal is suspended until such time as the appeal is adjudicated. 2. Student appeals are submitted to Parking Services and heard by the Student Judiciary Cabinet in accordance with their procedures. Appeal forms are available at Parking Services or at the Student Government Association office.
3. Faculty and staff appeals are submitted to Parking Services and heard by a 3-member Faculty/Staff Parking Appeals Committee appointed by the president. The committee will consist of two faculty members and one staff member who serve two-year terms. This committee will meet once a semester to hear appeals. |
